The Nosara legal risk map

Nosara draws wellness and eco-luxury buyers from the US and a growing population of digital nomads — and the marketing is built around Playa Guiones surf, Pelada sunsets and a recognized Blue Zone. What the listings rarely lead with is that Nosara concentrates four legal risks more tightly than almost anywhere else on the coast. Here is where a foreign buyer actually gets hurt.

Is that Guiones or Pelada “beachfront” titled — or a concession?

This is Nosara’s dominant risk. Playa Guiones, Playa Pelada and Playa Nosara all sit inside the Maritime Terrestrial Zone (Zona Marítimo Terrestre): 200 meters inland from the ordinary high-tide line. The first 50 meters is public land no one can own or build on; the 50–200 meter strip is generally held by a municipal concession granted through the Municipalidad de Nicoya, recorded in a separate concession registry — not the National Registry title you think you are buying. Because Nosara’s value lives so close to the sand, its concession exposure is among the highest on the Gold Coast. Pay a titled-land price for a time-limited concession right and you have made the single most expensive mistake a foreign buyer can make here.

At these prices, the difference between titled land and a concession is six or seven figures. It is worth confirming in writing.

Will the lot ever get a valid water letter?

Nosara does not sit on one tidy AyA water network. Much of it depends on wells drawing from the local aquifer, or on an ASADA — a community-administered water association — supplying a specific sector. In the stressed districts, the water authority has been reluctant to issue new water-availability letters (carta de disponibilidad de agua), and without that letter a lot can be effectively unbuildable no matter how clean the title is. A gorgeous, correctly-titled Guiones-adjacent lot with no path to a water letter is not a homesite; it is a very expensive place to park a car.

Can you legally reach it — and what may you build on it?

Two quieter Nosara risks close the map. First, access: many parcels are reached by unpaved roads and depend on a registered access easement (servidumbre) rather than public road frontage. If that easement isn’t recorded against your specific parcel in the National Registry, you can own land you have no legal right to cross. Second, covenants: in parts of Nosara the Nosara Civic Association maintains community rules that restrict building, setbacks and land use — a private layer sitting on top of the municipal uso de suelo and any SETENA environmental requirement. The lot that looks perfect until the water letter

Consider a hypothetical buyer — a US couple planning a wellness home a short walk from Playa Guiones. The title is clean, the price sits mid-band for a Nosara lot, and the agent is ready to move to escrow. On review, two things surface: the sector is served by an ASADA that has not issued a new water-availability letter in that stretch, and legal access runs across a neighbor’s land through an easement that was never registered against this parcel. Neither shows up on the listing. The honest recommendation here is to walk — or to make both a written condition of closing before a single dollar moves. That is the entire point of an independent review: to find the problem while walking away is still free.
