Can a foreign company bid on Costa Rican government contracts?
Potentially, yes, depending on the tender and the required legal and technical qualifications. The bidding entity must be able to satisfy the tender specifications, registrations, electronic-signature and SICOP requirements, guarantees and any local tax or corporate conditions stated in the procurement documents.
What is SICOP in Costa Rica?
SICOP is Costa Rica's integrated public procurement platform. Tender documents, clarifications, bids, notices and many procedural deadlines are handled electronically. A supplier needs both a legally admissible offer and disciplined operational control of the platform.
When should a supplier challenge tender specifications?
A restrictive, illegal or technically impossible requirement should be challenged during the objection period for the tender specifications. Waiting until the award stage may make the objection untimely because the supplier competed under rules it did not challenge.
Can an award decision be appealed?
Depending on the procurement threshold and procedure, the remedy may be an appeal before the Comptroller General or a revocation request before the contracting authority. Standing, timing and proof that the challenger could obtain the award are central.
